New procedure for British nationals to get residency permit in Spain as a consequence of the Brexit process

 

As a consequence of the Brexit process, the United Kingdom is no longer one of the European State Members (EM). This, as well as in other areas, has an effect on the residency permit procedure, and what has been known as the “green residency paper” will not be issued any more for British citizens from the 31st December 2020, as this document is issued only for EM citizens.

 

Points to understand what is going on:

 

-TIE cards have not been issued for European State members since 2007. Instead, European State members get the “green residence paper” to prove their residence in Spain. This document does not include a photograph because their identification document remains their own country’s passport or identification card.

 -TIE card is not a new issue, only a new procedure has been developed. The TIE legal normative is LO 4/2000 11 January and RD 557/2011 20th April.

 -NIE and TIE are different things, TIE is the document to prove the legal situation of a foreigner in Spain that contains your fingerprint and photo. NIE is a personal number to identify any foreigner in Spain, whether a European state member citizen or not.

 

In this context, the UK is considered as a Third State (TE) now, and so, British people living in Spain and any other EM country, may identify themselves with a Foreign Identification Card (TIE), and from 6th July, the Spanish government has developed a new procedure to get this, with two different stages:

 -From 6th July to 31st December 2020. Continues quite like previously, and evidence of financial and healthcare requirements remain the same.

-From 1st January 2021 on. Although there is nothing decided for sure, if a bilateral agreement between Spain and UK is not reached, the requirements for British people to get permanent residence permits will be the same ones that apply to any non-EU foreigners.

  The new procedure up to the 31st December 2020

Have you got a less than 5 years residence permit? Fill in the right form, pay the government tax, apply for your online appointment, provide your passport and a photo and you will get a 5 years residence permit.

 Have you got a more that 5 years residence permit? Fill in the right form, pay the government tax, apply for your online appointment, provide your passport and a photo and you will get a 10 years residence permit.

 Have you got a permanent green resident permit? With the current rules, it is not mandatory to get a TIE card if you already have a permanent green residence permit. However, we advise you to do so, as from 1st January rules might change and more restrictions could come along.

 Is your first time applying for a residence permit? Fill in the right form, pay the government tax, apply for your online appointment, and you will get a 5 years residence permit. Provide:

-passport

-photo

-any kind of documents to prove residence in Spain before the 31st December 2020

-proof of economic resources. If you are  working or are a pensioner, the self employer registration that includes health care cover, or the working contract that includes health care cover, or pension certification. If you are not working, bank account (or another proof) with funds enough to live without working and private or public health care insurance

Also:

If you are student.

-Enrolment document.

-personal declaration of enough economic resources.

If you are under a relative’s care:

-Proof of the family relation.

-Empadronamiento certificate of the family unit, this is to be registered at the Town Hal where you live

-TIE of the relative you are under care
